The Case & Challenge
The applicant, an Indian QA Engineer / SDET, applied for Spain’s Digital Nomad Visa from within Spain based on his long-standing remote professional relationship with a company in India. He had been working with the company since May 2021, performing software quality assurance, test automation, and system validation remotely.
During the evaluation, UGE issued a three-part requerimiento that required more than simply providing an additional missing document.
First, UGE requested translated income records for the previous three months together with bank evidence clearly matching the payments received. Second, they requested official proof that he had been registered as self-employed in India for at least three months.
The third issue was different: UGE considered his profession to be regulated and therefore requested either homologation of his qualification in Spain or a notarized declaration confirming that he would not exercise the regulated profession in Spain.
The Strategy & Solution
We addressed the three issues separately.
For the self-employment requirement, we submitted the applicant’s GST Registration Certificate, duly apostilled and sworn translated into Spanish. His GST registration showed that he operated as a sole proprietor and had been registered since April 2019, comfortably exceeding the three-month period requested by UGE.
We also provided the translated income documentation for October, November, and December 2025 together with bank evidence, with the corresponding payments identified so UGE could easily connect the income received to the supporting records.
The regulated-profession issue required a different approach. Rather than pursuing homologation of his engineering qualification, the applicant executed an Acta de Manifestaciones before a Spanish notary, formally declaring that he would not exercise the regulated profession of engineer in Spain. The notarized declaration directly addressed the alternative offered by UGE in the requerimiento.
The Outcome
The complete response successfully satisfied UGE’s concerns, and the application was approved on March 10, 2026.
The applicant received his Initial Residence Authorization for International Teleworkers, valid until March 9, 2029. Interestingly, the final resolution identifies the applicant under “AUTONOMO,” confirming the approval of the application on a self-employed basis.
This case stands out because the requerimiento involved three different aspects of DNV eligibility at once: income verification, self-employed registration, and a regulated profession. By using the applicant’s GST registration, clearly matched financial evidence, and a notarized declaration as an alternative to homologation, we were able to resolve each issue and secure a three-year Digital Nomad Visa approval.
