The Case & Challenge

The applicant, a Filipino professional, had been working for several years with a client company based in Dubai, UAE. She submitted an in-country application for the Spain Digital Nomad Visa (DNV).

Initially, her application was submitted under an employee status. However, Spain’s Unidad de Grandes Empresas (UGE) issued a strict requirement: the foreign employer had to register with the Spanish Social Security as a non-resident entity and commit to contributing to the system. Because the UAE company was unable to fulfill this complex cross-border corporate registration, the initial application was officially denied on August 12, 2025.

Following the rejection, the applicant considered filing an administrative appeal to argue that the operational relationship was continuous and unchanged. However, based on extensive administrative trends, our team advised against an appeal due to excessively long processing times that can drag on for over a year. Instead, the strategic recommendation was to transition to the independent contractor route.

The main procedural hurdle was timing: to qualify as a self-employed contractor, the regulations strictly demand proof of at least a 3-month pre-existing mercantile relationship. Even though she had years of history with the company, the formal transition to a contractor framework meant she had to wait out a full three-month window before she could legally reapply.

The Strategy & Solution

Once the mandatory three-month transition period was met, we prepared the file for resubmission under our submission-only framework, ensuring meticulous pre-screening to eliminate any structural gaps:

• Shifting to the Autónomo Framework: We restructured her entire application profile from an employee setup to a self-employed/independent contractor modality. This allowed her to sign a formal pledge to register with the Spanish Social Security (Autónomo) independently, completely bypassing the need for her UAE employer to register in Spain.
• Evidencing the 3-Month Mercantile Buffer: We meticulously compiled and cross-referenced her updated independent contract, localized bank statements, and invoice histories to conclusively prove that she had completed the mandatory three months of self-employment following her transition.
• Strict Quality Pre-Review: Even though the applicant utilized our submission-only package, our team executed a thorough pre-screening of all structural documents—including her corporate registration certificates from the UAE, remote work authorization letters, and international background checks—to guarantee compliance.

The Outcome

By strategically waiting out the transition period instead of getting bogged down in a lengthy appeals process, the applicant completely eliminated the legal friction surrounding her employer’s tax status.

The resubmitted application was registered on October 6, 2025, and went through the system flawlessly, resulting in an approval on October 28, 2025—completely free of any requests for additional documentation (requerimientos). The UGE granted her a full initial residence permit valid until October 27, 2028.
