The Case & Challenge
The main applicant, a Pakistani marketing consultant, applied from Spain with her spouse and minor child as dependents. She provides independent professional services to a company in Georgia, USA, with an ongoing relationship dating back to 2023.
Her work includes marketing strategy, digital campaigns, market research, brand communications, content planning, performance reporting, and project coordination. The services can be delivered entirely through computers, internet, and other digital tools, without physical attendance at the company’s premises.
The Strategy & Solution
We submitted the main application electronically through UGE on August 21, 2026. The file clearly distinguished her independent contractor arrangement from employment: both the services agreement and the company’s remote-work letter confirmed that she was an independent marketing consultant, not an employee.
- The services agreement and remote-work authorization documented the continuing relationship, professional duties, remote delivery, and regular consulting fees.
- Bank records and income evidence supported the professional income declared in the application.
- Company registration, qualification and experience evidence, and sworn Spanish translations formed part of the supporting file.
- The application also included the standard identity, criminal record, entry and residence documents, fee-payment evidence, and a commitment to register as an autónomo in Spain.
Explaining the UAE Documentation
Because the applicant had been residing in the United Arab Emirates, the initial file included an explanatory letter addressing her tax identification and self-employment documentation. She explained why a personal tax identification number and specific self-employment registration documents were not available in her circumstances, and supplied her UAE residence permit as supporting evidence.
This was an explanation of her individual situation, not a blanket exemption for everyone residing in the UAE. The services agreement, remote-work letter, and income records helped document the actual professional relationship alongside that explanation.
Positive Administrative Silence
After the legal decision period had elapsed, a request dated September 30, 2026 sought documentary confirmation of approval through positive administrative silence. The request stated that no express decision or notification suspending or extending the decision period had been received at that point.
The eventual resolutions expressly recognize that the legal decision period had passed and grant the requested authorizations through positive administrative silence. Read more about this procedure in our administrative silence guide.
The Outcome: All Three Family Members Approved
The main applicant’s resolution and both dependent resolutions were signed on October 29, 2026. This signed approval date is also the story’s publication date; it is not inferred from the permit’s expiry date.
The main applicant’s authorization is valid until September 17, 2029. Her spouse and minor child were also approved, with their authorizations linked to hers and sharing the same expiry date.
The family can now proceed with the applicable residence-card formalities, while the main applicant completes her required autónomo registration. Our guides explain how to apply for a TIE card and registering as an autónomo after DNV approval.
This case highlights the importance of documenting the correct professional arrangement, explaining unavailable documents in the applicant’s specific circumstances, and following up when the decision period has elapsed. Each application is assessed individually, and this outcome does not guarantee approval in another case.
